The frequency of trucking accidents caused by truck drivers under the influence of drugs or alcohol is an alarming trend. The proposal set forth by the FMSA involves the use of a national drug and alcohol clearinghouse for all drivers who possess a commercial driver’s license (CDL). It would require all interstate commerce companies to register their drivers in the clearinghouse. The system would then be used to report any drivers who have tested positive for drugs or alcohol in the past, and any who refuse to be tested. The current screening process is a flawed system, which only catches a small percentage of offending drivers. This is because most drivers won’t disclose their history of failed drug tests or DUI’s in order to gain employment.

The new system would make it mandatory for these drivers to report their test results each year. If commercial drivers fail to report past transgressions, they will be faced with severe civil and criminal punishment. Commercial drivers would also be identified by their state vehicle registrations and their CDL’s as opposed to their Social Security numbers. Dangerous drivers would no longer be able to slip through the cracks and find themselves behind the wheels of massive big rigs to once again endanger lives.
